Are you eligible for a record expungement?

Below is a form you can fill out to help determine whether you qualify for an expungement.

Is a criminal case pending against you in any jurisdiction? no / yes
Are you being investigated in any jurisdiction? no / yes
Have you ever been convicted of 2 or more felonies? no / yes
Is a criminal case pending against you in any jurisdiction? no / yes
Have you ever been convicted of three or more crimes and two of them are class A misdemeanors? no / yes
Have you ever been convicted of four or more crimes and three of them are class B misdemeanors? no / yes
Have you ever been convicted of five or more crimes other than infractions (minor traffic citations, etc.)? no / yes
If you answered “Yes” to any of the questions above then you probably do not qualify for an expungement. If you answered “No” to all of the questions above then move on to the next appropriate section to see if you qualify.

If you WERE NOT CONVICTED of the crime you want to expunge:

Were you arrested for that crime within the last 30 days? no / yes
Have you been arrested since then? no / yes
If you answered “Yes” to either of those questions then you probably do not qualify for an expungement. If you answered “No” to both of those questions then move on to the next section to see if you qualify.

Mark all that apply:

No charges were filed. no / yes
Charges were filed, but the case was dismissed with prejudice. no / yes
Charges were filed, but I was acquitted at trial. no / yes
The statute of limitations has expired. no / yes
If you marked “yes” to anyof the statements above then you may qualify for an expungement of a crime for which you were not convicted.

If you WERE CONVICTED of the crime you want to expunge:

A capital felony, first degree felony or violent felony no / yes
Automobile homicide no / yes
Felony driving under the influence no / yes
A registerable sex offense no / yes
If you marked “yes” to any of the crimes above then you probably do not qualify for an expungement unless you have been pardoned for the offense. If you did not mark any of the boxes above then continue to the next section to see if you qualify.

Were you convicted of misdemeanor DUI? no / yes
Were you convicted of a felony for driving under the influence of a controlled substance and negligently causing serious bodily harm or death to another person? no / yes
If you answered “Yes” to either of the questions above then you may qualify for an expungement of that offense if 10 years have passed since you were convicted or released from incarceration, probation or parole, whichever occurred last. If you answered no, then continue to the next section.

Were you convicted of misdemeanor DUI? no / yes
If you answered “Yes” to either of the questions above then you may qualify for an expungement of that offense if 10 years have passed since you were convicted or released from incarceration, probation or parole, whichever occurred last. If you answered no, then continue to the next section.

Were you convicted of a felony? no / yes
If you answered “Yes” to the question above then you may qualify for an expungement of that offense if 7 years have passed since you were convicted or released from incarceration, probation or parole, whichever occurred last. If you answered no, then continue to the next section.

Were you convicted of a Class A misdemeanor? no / yes
If you answered “Yes” to the question above then you may qualify for an expungement of that offense if 5 years have passed since you were convicted or released from incarceration, probation or parole, whichever occurred last. If you answered no, then continue to the next section.

Were you convicted of a Class B misdemeanor? no / yes
If you answered “Yes” to the question above then you may qualify for an expungement of that offense if 4 years have passed since you were convicted or released from incarceration, probation or parole, whichever occurred last. If you answered no, then continue to the next section.

Were you convicted of Class C misdemeanor? no / yes
If you answered “Yes” to the question above then you may qualify for an expungement of that offense if 3 years have passed since you were convicted or released from incarceration, probation or parole, whichever occurred last.
