UTAH JUVENILE COURT SYSTEM
Protecting Your Children During Juvenile Proceedings
Juveniles are subject to the same laws as everyone else. But when they break those laws, the court system they face differs drastically from that faced by similarly situated adults. The Utah juvenile court system promotes rehabilitation over punishment and, as a result, can be substantially more complicated than the regular court system. And criminal defense attorneys without specific experience with juvenile cases may quickly find themselves overwhelmed. Our attorneys at Intermountain Legal have handled numerous juvenile cases of all types. We understand the system and have practical experience dealing with the complex issues that children face during the process.
About The Juvenile Court System
Utah’s Juvenile Court is composed of 28 full-time judges statewide. Its jurisdiction extends to numerous matters involving minor children:
- Criminal offenses by children
- Abused, neglected and dependent children
- Custody and visitation in some cases
- Termination of parental rights
- Juvenile probation
- Foster care and special treatment placement
While the juvenile court has broad jurisdiction, our practice at Intermountain Legal focuses on defending children against charges of delinquency and defending parents when the Division of Child and Family Services attempts to remove their children. Most violations of state or federal law as well as local ordinance are delinquency cases. While the juvenile process is very different, some essential elements — such as many of the defendant’s rights to a defense — are the same. Because the juvenile system is remedial in nature, the penalties imposed are usually much more flexible, giving an experienced juvenile defense attorney many opportunities to work with the state’s attorney and the court to reach a more favorable result.
For parents facing allegations of child abuse, the prospect of having your children removed is very real and should be handled accordingly. Resisting these allegations requires a thorough understanding of the applicable law as well as the individual circumstances of each client. At Intermountain Legal, we appreciate the complexity of these cases and take the time with our clients to fully understand what they are going through. We fight hard to defend their parental rights and to favorably resolve child abuse allegations so they can get on with their lives.
