We’re back with another Utah Defense Attorney Tip of the Week! This simple tip will save you unnecessary trouble if you have an unfriendly encounter with the police.
Our local law enforcement exists to protect us, not to make us uncomfortable. There is no need to feel pressured or scared in a police encounter, but if you are uneasy, there are ways to deal with the situation in a legal and calm manner. Remember, knowledge gives us the power to think and act clearly in any heart-pounding situation. Let’s dive in!
Faking temporary deafness so you don’t have to answer police questions probably isn’t the best idea. Lying to a police officer is never wise, no matter how convenient it might seem.
If you start busting out pretend sign language, the officer is more likely to think you’re flashing some sort of Canadian gang sign rather than believe you are hearing impaired. Save yourself the trouble, and answer questions honestly and simply.
If you are in a situation where you feel you are being pressured by an officer or are uncomfortable with the questions they are asking, you should ask, “Am I being detained, or am I free to go?”
If they tell you you’re being detained, you should ask for a defense attorney and politely decline to answer any more questions. At that point, they’ll read you your rights.
If they say you can go, thank them and walk or drive away immediately.
As always, if you have any questions about this process or need help with any legal problems, contact Intermountain Legal. Our team of attorneys in Utah will give your situation the thought and consideration it deserves.
